1) Acceptance of terms
By accessing or using Waptix (“Service”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.
2) Eligibility
Waptix is intended for business use only. You represent that you are acting on behalf of a business, have authority to bind that business, and are at least 18 years old.
3) Compliance with WhatsApp and Meta policies
- You must comply with the WhatsApp Business Policy and Commerce Policy.
- You are solely responsible for obtaining and maintaining valid opt‑in consent from your contacts before messaging them.
- You must use approved templates for business‑initiated messages.
- You may not upload purchased, rented, or scraped contact lists.
- You may not use Waptix for illegal, harmful, deceptive, gambling (unless licensed), adult content (unless compliant), or prohibited industries per Meta rules.
4) Account registration and security
You must provide accurate account and billing information. You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately if you suspect unauthorized use.
5) Subscription, billing, and refunds
- Waptix is offered on a subscription basis. Fees are billed in advance and are non‑refundable except as required by law or expressly stated in a Refund Policy.
- You authorize us (or our payment processors) to charge your chosen payment method.
- Taxes may apply depending on your jurisdiction.
- You may cancel at any time; your service will continue until the end of the current billing cycle.
6) Use of the service
- Waptix grants you a limited, non‑exclusive, non‑transferable license to use the Service for your internal business purposes.
- You may not reverse engineer, resell, sublicense, or misuse the Service.
- You are responsible for the actions of your employees, contractors, and agents using Waptix on your behalf.
7) Data ownership
You retain ownership of all data you upload. By using Waptix, you grant us a license to process that data solely to provide the Service. See our Privacy Policy for details.
8) Service availability
We strive for high uptime, but Waptix is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted or error‑free service. Scheduled maintenance, outages, and issues outside our control (e.g., Meta platform downtime) may affect availability.
9) Termination
We may suspend or terminate your account immediately if you violate these Terms, Meta’s policies, or engage in abuse. You may terminate at any time by ceasing use. Upon termination, your right to use the Service ends immediately.
10) Limitation of liability
To the maximum extent permitted by law, Waptix and its affiliates are not liable for indirect, incidental, or consequential damages, lost profits, or loss of data arising from use of the Service. Our total liability shall not exceed the fees paid to us in the 3 months preceding the claim.
11) Indemnification
You agree to indemnify and hold harmless Waptix, its officers, and employees from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
12) Governing law
These Terms shall be governed by and construed under the laws of India, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts of India.
13) Changes to these terms
We may update these Terms occasionally. If changes are material, we will notify you by email or in‑app. Continued use of Waptix after changes means you accept the updated Terms.
